Canadian Shihan Taikai 2010 - May 22nd and 23rd - Toronto, Ontario Terms and Conditions PLEASE READ CAREFULLY BEFORE AGREEING. YOU HAVE THE RIGHT TO REFUSE TO AGREE TO THESE TERMS AND CONDITIONS, HOWEVER, AGREEMENT IS REQUIRED IN ORDER TO PARTICIPATE IN THE CANADIAN SHIHAN TAIKAI 2010. For the purposes of this agreement, the term “SEMINAR HOSTS” will be understood to mean: “The following people and organizations and any person, organization or business associated with them in any way: The Japanese Canadian Cultural Centre, The Bujinkan Hombu Dojo, BujinkanCanada.org, Bujinkan Kageyama Dojo, Craig Olson, and “SEMINAR INSTRUCTOR” will be understood to mean all those persons named and described in the instructors section of the BujinkanCanada.org web page. 1. I declare that I am at least 18 years old or am the parent or guardian of a minor less than 18 years old who is applying to attend the Canadian Shihan Taikai 2010 and (hereinafter collectively referred to as “I” “my” and “me”) I have read and consented to the following terms and conditions. 2. I warrant and represent that I am in good health and that there are no special problems associated with my health that are not specifically written in these terms and conditions (and if signing on behalf of a minor as parent or guardian, I represent that the minor is in good health and has no special health problems that are not specifically written in these terms and conditions), and that I am mentally and legally competent to understand this agreement and enter into its terms. 3. I certify that I am a Bujinkan Member for the year 2010 and agree to follow the rules of conduct set forth by the Bujinkan Hombu Dojo described for my reference on BujinkanCanada.org and agree that the SEMINAR HOSTS reserve the right to refuse admittance to me should I not follow the rules of conduct. 4.I hereby agree that any photographs and/or videos taken of me during my participation in this seminar may be used for publicity or any other use seen fit by the SEMINAR HOSTS, without any compensation to my parents, guardians, heirs, benefactors or myself. I hereby waive any right I may have to inspect and/or approve any photographs and/or videos of myself. 5. I agree and understand that Martial Arts is dangerous and that participating in a Martial Arts seminar such as the Canadian Shihan Taikai 2010 can be a hazardous activity. Further, I have been informed of, and do recognize and accept the risks of suffering bodily harm, injury, incapacitation, other disability, disfigurement or death and agree that activities connected with Martial Arts or participating in any activity carried on by the SEMINAR HOSTS and/or SEMINAR INSTRUCTOR is done with the distinct understanding that I do so entirely at my own risk. 6. I understand that I will not be forced to do anything against my will, and that I am in control of my own conduct and the manner in which I perform Martial Arts techniques, sparring, and similar activities, and I will conduct myself in such a manner as to be safe and not endanger myself, others or the facility. 7.Indemnity I hereby assume all risks which may be associated with, and/or result from, my involvement in the Canadian Shihan Taikai 2010 and the aforementioned Martial Arts activities and on behalf of myself, my heirs, my executors, my administrators and assigns, I expressly agree to hold harmless, release and indemnify the SEMINAR HOSTS and the SEMINAR INSTRUCTOR of and from any liability, claim, demand, action and cause of action whatsoever arising out of or in any way related to any loss, expense, damage, or injury (including death) that may be sustained by me while travelling to, participating in, returning from the Canadian Shihan Taikai 2010 Martial Arts seminar or which might arise thereafter, against any person or entity in any way connected with the seminar and any related or collateral activity, including, but not limited to, injuries and damage caused by the negligence and/or breach of warranty, express or implied, on the part of the SEMINAR HOSTS or the SEMINAR INSTRUCTOR. 8. By execution of this agreement, the SEMINAR HOSTS and the SEMINAR INSTRUCTOR shall be indemnified and released from liability for any injury to other person(s) or property damage which I may cause as a result of engaging in the aforementioned activities. 7. IN THE EVENT ANY SECTIONS OF THIS RELEASE ARE FOUND TO BE UNENFORCEABLE, THE REMAINING TERMS SHALL REMAIN IN FULL FORCE. 8. This release shall be binding to the fullest extent permitted by law. I HAVE CAREFULLY READ THE FOREGOING TERMS AND CONDITIONS INCLUDING THE LIABILITY RELEASE, UNDERSTAND ITS CONTENTS, AND NOT BEING UNDER ANY DURESS AGREE TO IT WITH FULL KNOWLEDGE OF ITS SIGNIFICANCE.
